Millry Long Distance
36 Month Agreement
This agreement entered into this day of ___, 20__,
by and between Millry Long Distance ("Provider") located at 30433 Highway 17,
Millry, Alabama 36558 and ('Customer") located at _________________________________.
The customer agrees to pay the provider for all long distance service furnished the customer initially or in the future, at
its legally authorized rates as now in effect or as may hereafter be authorized by the Alabama Public Service
Commission and/or Federal Communications Commission. The provider shall provide the following service:
Long distance service discounted at the rate of 30% off the standard rate
for long distance calls handled & billed by Millry Long Distance.
1. In exchange for the discounted rate of 30%, customer will
sign an agreement stating they will maintain Millry Long Distance as their Primary
Long Distance Carrier for a minimum period of 36 months from the date service
is established. This agreement shall be automatically renewed (on a month to
month basis) at the end of the initial term; provided, however, that after the
expiration of the initial term either party may terminate this agreement by
providing written notice to the other party; and provided further that Customer
shall remain responsible for all charges incurred up through and including the
date of service termination.
2. It is understood that if this agreement is terminated before the expiration of the 36-month period, an early termination charge will be paid by the customer to the provider for the unexpired portion of the period, determined as follows:
The customer shall pay to the provider a $150.00 early termination charge.
3. The customer may terminate this agreement after acceptance
and before connection of said service is completed upon payment to the provider
for services rendered in process of this agreement such as service orders, rearrangements,
and charges to the provider by its supplier company for cancellation which has
been incurred by the provider at the time of such termination.
4. The provider's performance hereunder is subject to interruption and delay
due to causes beyond reasonable control such as Acts of God, acts of government,
war or other hostility, civil disorder, the elements, fire, explosion, power
failure, equipment failure, industrial labor disputes, inability to obtain necessary
supplies and the like.
5. The provisions hereof shall inure to the benefit of and be binding upon the successors and assigns of the
respective parties hereto.
It is mutually understood both parties hereto specifically state the execution of this contract, and that both parties
of each organization are properly authorized to do so.
